White Supremacists Demand Thurgood Marshall's Rulings Be Thrown Out

Following the Proposition 8 backers' successful quest to get California Chief Judge Vaughn Walker's Prop 8 injunction thrown out, White Power America filed a motion in District Court this morning to vacate all rulings on race matters made by the Supreme Court in which Justice Thurgood Marshall took part.

A Freedom of Information Act request recently revealed that the US government was helping Justice Marshall conceal the fact that he was black until his death in 1993.  Critics allege that Justice Marshall did not recuse himself from race cases.

"This is an outrage!" said an anonymous skinhead.  "Black men should recuse themselves from any case that touches on civil rights issues.  Only white men are capable of making a fair decision here."

An anonymous source close to the group also suggested that a plan was in the works to get landmark women's rights cases overturned on similar grounds.  "Justice O'Connor authored the controlling opinion in the landmark Planned Parenthood v. Casey case, yet she did not reveal until last year that she was a woman.  Women should not be deciding cases that bear on women's rights," the source said.

Senator Jon Kyl lent his sympathies to both efforts on the floor of the Senate.  "What right do blacks and women have deciding cases at all!?" he bellowed.  An aide to Senator Kyl later clarified the Senator's remarks.  "What Senator Kyl said on the floor of the Senate was not intended to be taken as a factual statement," the aide said.
